To qualify for Shinesty's Saucy Santa Free Gift Giveaway a "Qualifying Order" must be placed between November 22nd, 2023 at 10:00 PM Mountain Time and November 28th, 2023 at 4:00AM Mountain Time. A Qualifying Order subtotal must be greater than or equal to $1 to earn the tier 1 gift. To qualify, a Qualifying Order must be made for a new subscription or new ecommerce order and cannot be a recurring subscription order. For the purposes of this promotion, a "recurring subscription order" is defined as an order which renews during the promotion as part of an automatic subscription plan (e.g. Monthly Ball Hammock Underwear Subscription) created at any point before the start of the promotion. Recurring subscription orders that do not qualify for free gifts include those placed through the Subscriber Account Page Portal (account.shinesty.com) using "Edit Schedule" or "Send It Now" functionality.

• By participating in the Promotion, you represent and warrant that 1) you are 18 or older at the time of purchase; and 2) you agree to comply with the following terms
• All gifts are non-refundable, non-exchangeable and cannot be redeemed for store credit or cash. If you choose to return a product ordered during a stacking gifts promotion, you must also return any free gifts received with that order to receive a refund in full. Exchanges are exempted and do not require free gifts be returned.
• No gift is guaranteed with any purchase. Gifts are limited in quantity and distributed on a first-come, first-served basis. In the event a gift is unavailable, Shinesty reserves the right to provide similar substitute gifts other than those pictured or described.
• To qualify for a gift, you must meet the Order Subtotal value conditions of each tier set forth below in your cart before any applicable shipping, taxes, or post purchase upsell products are added in checkout. Each Order Subtotal is equal to the sum of product price less any product line-item discounts. All Order Subtotal value tiers are subject to change at any time at Shinesty's sole discretion.

• All products will be automatically applied to your cart while shopping or you will be prompted to make a selection. If your order includes a pre-order item, gifts will be sent at the time of fulfilling the pre-order item(s).
• The Promotion is only valid for orders placed on Shinesty.com, excluding orders placed through the Subscription Account Page experience (account.shinesty.com). Orders placed off shinesty.com (e.g. Amazon, Walmart+, TikTok Shops, Meta Shops) will not receieve free gifts.
• Shinesty provides all gifts on an as-is basis, without representations or warranties of any kind.
• Shinesty may change the terms of, suspend, or end the Promotion at any time in its sole discretion. Shinesty will make changes to the Promotion by publishing a revised set of these terms on this page.
• Shinesty may start and end the promotion at any time, without notice.
• The Promotion may not be used in conjunction with any other promotion offered by Shinesty.
• The Promotion is subject to all applicable laws and is void where prohibited. YOU ASSUME ALL LIABILITY FOR ANY INJURIES OR DAMAGE CAUSED BY PARTICIPATION IN THE PROMOTION OR YOUR USE, OWNERSHIP, TRANSFER,SALE, OR OTHER DISPOSITION OF ANY GIFT.
• All causes of action arising out of or connected with the Promotion must be resolved individually before a court of competent jurisdiction located in the State of Colorado. All disputes will be governed by the laws of the State of Colorado.
