1. Sponsor and Administrator The Father’s Day Exotic Hairline Giveaway (the “Sweepstakes”) is sponsored and administered by Shinesty, Inc. (“Sponsor” or “Shinesty”), 6050 Washington Street, #130, Denver, CO 80216.
2. Definitions Capitalized terms used in these Official Rules have the meanings set forth in this Section 2 or as otherwise defined herein. “ARV” means approximate retail value. “Entrant” or “you” means any natural person who enters the Sweepstakes in accordance with these Official Rules. “Entry Period” means the Sweepstakes Period, defined in Section 4. “Official Rules” means this document, as amended from time to time. “Prize” means the prize described in Section 8. “Qualifying Purchase” means any retail purchase of one or more products at https://www.shinesty.com made during the Sweepstakes Period using promotional code “NEWHAIR” at checkout. “Released Parties” has the meaning set forth in Section 12. “Winner” means the verified winner of the Prize.
3. Eligibility The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age (or the age of majority in their jurisdiction of residence, whichever is older) at the time of entry. The Sweepstakes is void in U.S. territories and possessions, on overseas military installations, and where otherwise prohibited or restricted by law. Employees, officers, directors, agents, representatives, and contractors of Shinesty and its parents, subsidiaries, affiliates, advertising and promotion agencies, and prize suppliers, and the immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and household members (whether related or not) of each such person, are not eligible to enter or win. By entering, each Entrant represents that he or she meets all eligibility requirements. Sponsor reserves the right to verify eligibility and to require an Entrant to provide proof of eligibility (in a form acceptable to Sponsor) as a condition of receiving the Prize.
4. Sweepstakes Period The Sweepstakes begins on May 15, 2026 at 12:01 a.m. Mountain Time (“MT”) and ends on June 21, 2026 at 11:59 p.m. MT (the “Sweepstakes Period”). Sponsor’s computer is the official time-keeping device for the Sweepstakes. Entries received outside the Sweepstakes Period will not be eligible.
5. How to Enter There are two (2) ways to enter the Sweepstakes during the Sweepstakes Period. Both methods of entry have equal weight and the same chance of winning. No purchase is necessary. (A) Free Online Entry (No Purchase Necessary) Visit the official entry page at https://shorturl.at/xHmG1 and complete the online entry form, providing your full legal name, complete mailing address, email address, telephone number, and date of birth. Each properly completed online entry will receive one (1) entry in the random drawing. Limit one (1) free online entry per person, per email address, per household, per calendar day during the Sweepstakes Period. (B) Purchase Entry Make any Qualifying Purchase at https://www.shinesty.com using promotional code “NEWHAIR” at checkout during the Sweepstakes Period and you will automatically receive one (1) entry in the random drawing for each Qualifying Purchase. There is no limit on the number of entries an Entrant may earn through Qualifying Purchases. (C) General Entry Provisions Entries received through any method other than as described in these Official Rules are void. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, garbled, misdirected, or undelivered entries; all such entries are void. Use of any automated, robotic, programmed, scripted, or similar means of entry, or any entry by an agent or proxy on behalf of an Entrant, is prohibited and will result in disqualification. Sponsor reserves the right to disqualify any Entrant who tampers with the entry process or the operation of the Sweepstakes, or who is found, in Sponsor’s sole discretion, to be in violation of these Official Rules. The use of multiple identities, email addresses, or accounts to attempt to gain entries beyond the limits set forth in these Official Rules is prohibited and will result in disqualification of all of an Entrant’s entries.
6. Submission Content Entries are not judged or scored. The Winner is selected solely by random drawing. Any optional written content submitted in connection with an entry must be the Entrant’s original work and must not contain content that is unlawful, defamatory, obscene, sexually explicit, hateful, threatening, harassing, infringing, or otherwise objectionable, as determined by Sponsor in its sole discretion. Sponsor reserves the right to disqualify any Entrant whose submission, in Sponsor’s sole discretion, violates these Official Rules.
7. Winner Selection and Notification On or about June 30, 2026, Sponsor or its designated representative will randomly select one (1) potential winner from among all eligible entries received during the Sweepstakes Period. The odds of winning depend on the total number of eligible entries received. The potential winner will be notified by email and/or telephone using the contact information provided at entry. The potential winner must respond within three (3) business days of the first attempt at notification, complete and return all required documentation as set forth in Section 9 within seven (7) business days, and otherwise comply with these Official Rules. If the potential winner cannot be reached, fails to respond, fails to return required documentation timely, is found to be ineligible, declines the Prize, or is otherwise unable or unwilling to accept the Prize, the potential winner will be disqualified and an alternate winner may be selected, in Sponsor’s sole discretion, from among the remaining eligible entries. After three (3) such alternate selections, Sponsor reserves the right not to award the Prize.
8. Prize and Approximate Retail Value One (1) Grand Prize will be awarded, consisting of Four Thousand Nine Hundred Ninety-Nine U.S. Dollars ($4,999.00) paid in the form of a check or electronic funds transfer payable to the verified Winner (the “Prize”). The approximate retail value (“ARV”) of the Prize is $4,999.00. Total ARV of all prizes to be awarded in the Sweepstakes will not exceed $4,999.00. The Prize is non-transferable and may not be substituted, exchanged, or redeemed except that Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value if the Prize becomes unavailable for any reason. The Winner is solely responsible for any uses of the Prize and any associated expenses, including, without limitation, all federal, state, and local taxes, banking or wire-transfer fees, and any costs incurred in receiving or using the Prize. The Prize is not intended to fund, reimburse, or finance any specific purchase, service, travel, or medical procedure, and Sponsor makes no representation, warranty, or recommendation regarding any use of the Prize funds.
9. Prize Acceptance, Affidavit, and Releases Before the Prize is awarded, the potential winner must complete, sign, and return to Sponsor: (i) an Affidavit of Eligibility and Liability/Publicity Release; and (ii) an IRS Form W-9 (collectively, the “Prize Documents”), each in a form provided by and acceptable to Sponsor. Failure to return the Prize Documents within seven (7) business days after they are provided to the potential winner will result in disqualification.
10. Taxes and Tax Reporting All federal, state, and local taxes on the Prize, and any other costs and expenses not expressly stated as part of the Prize, are the sole responsibility of the Winner. The Winner will be issued an IRS Form 1099-MISC reflecting the value of the Prize and is responsible for reporting all such income to the U.S. Internal Revenue Service and any applicable state taxing authority. The Winner must complete and return an IRS Form W-9 as a condition of receiving the Prize. Sponsor does not provide tax advice; the Winner is encouraged to consult a tax professional of his or her own choosing.
11. Privacy Information collected from Entrants in connection with the Sweepstakes will be used by Sponsor for the administration of the Sweepstakes and otherwise as described in Sponsor’s Privacy Policy, available at https://www.shinesty.com/pages/privacy. By entering, you acknowledge and agree to Sponsor’s collection and use of such information as described in the Privacy Policy and these Official Rules. Residents of California, Colorado, Connecticut, Virginia, and other U.S. states with comprehensive privacy laws may have additional rights as described in the Privacy Policy.
12. Release and Indemnification By entering, you (and, if you are the Winner, on behalf of yourself and your heirs, executors, administrators, successors, and assigns) release, discharge, indemnify, defend, and hold harmless Sponsor and its parents, subsidiaries, affiliates, advertising and promotion agencies, prize suppliers, and each of their respective directors, officers, employees, members, shareholders, agents, representatives, successors, and assigns (collectively, the “Released Parties”) from and against any and all claims, demands, damages, losses, liabilities, judgments, fines, penalties, costs, and expenses (including reasonable attorneys’ fees) of any kind whatsoever, whether known or unknown, asserted or unasserted, suspected or unsuspected, foreseen or unforeseen, arising out of or relating to: (a) the Entrant’s participation in the Sweepstakes; (b) the acceptance, possession, use, or misuse of the Prize; (c) any breach of these Official Rules; (d) any publicity or use of the Entrant’s name, likeness, voice, image, biographical information, or submission as authorized in these Official Rules; or (e) any taxes payable in connection with the Prize.
13. Limitations of Liability The Released Parties are not responsible for: (a) typographical, printing, technical, hardware, software, electronic, network, internet, server, computer, or telecommunications errors or failures; (b) lost, late, incomplete, undelivered, illegible, garbled, or corrupted entries; (c) human error; (d) unauthorized human intervention in any part of the entry process or the Sweepstakes; or (e) any other errors or difficulties relating to or in connection with the Sweepstakes. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE RELEASED PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE SWEEPSTAKES OR THE PRIZE, REGARDLESS OF THE FORM OF ACTION (WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), AND EVEN IF SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL THE AGGREGATE LIABILITY OF THE RELEASED PARTIES TO ANY ENTRANT EXCEED THE ARV OF THE PRIZE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE FOREGOING MAY NOT APPLY TO YOU.
14. Force Majeure; Modification; Cancellation If the Sweepstakes cannot be conducted as planned due to any cause beyond Sponsor’s reasonable control, including but not limited to fire, flood, earthquake, pandemic, epidemic, public health emergency, war, terrorism, civil disturbance, strike, governmental order or regulation, court order, technical or human error, computer virus, unauthorized intervention, fraud, or any other event that, in Sponsor’s sole discretion, could corrupt, threaten, or impair the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to: (a) modify, suspend, postpone, or cancel the Sweepstakes; (b) extend the Sweepstakes Period; (c) award the Prize from among entries received prior to the action taken; (d) substitute a prize of equal or greater value; or (e) take such other action as Sponsor deems appropriate.
15. Publicity Except where prohibited by law, by entering you grant Sponsor and its designees a worldwide, perpetual, irrevocable, sublicensable, royalty-free right and license to use your name, voice, photograph, video, likeness, biographical information, city and state of residence, statements, and any submission, in whole or in part, in any and all media now known or hereafter devised, for any advertising, promotional, marketing, publicity, or commercial purpose, without further notice, consideration, review, or approval. You waive any moral rights or rights of attribution to the fullest extent permitted by law. Where state law (such as Tennessee or other applicable jurisdictions) requires separate written consent for use of an Entrant’s name or likeness, the foregoing grant is conditioned on such additional consent, which Sponsor may request at the time of Prize acceptance.
16. General Conditions Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision.
17. Disputes; Governing Law; Arbitration; Class Waiver Except where prohibited, you agree that: (a) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes or the Prize will be resolved individually, without resort to any form of class or representative action, and exclusively by final and binding arbitration administered by JAMS in Denver, Colorado, in accordance with its Streamlined Arbitration Rules and Procedures, with the arbitrator’s decision being final and binding; (b) any and all claims, judgments, and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys’ fees; and (c) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, indirect, punitive, incidental, or consequential damages and any other damages other than actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, will be governed by and construed in accordance with the laws of the State of Colorado, without giving effect to any choice-of-law or conflict-of-laws rules or provisions that would cause the application of the laws of any other jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions of these Official Rules. Subject to the arbitration provisions, you and Sponsor consent to the exclusive jurisdiction and venue of the state and federal courts located in Denver County, Colorado for any action not subject to arbitration.
18. Winner List; Rules Request For a copy of these Official Rules or the name of the Winner, send a self-addressed, stamped envelope to Shinesty, Inc., Attn: Father’s Day Sweepstakes, 6050 Washington Street, #130, Denver, CO 80216. Rules requests must be received during the Sweepstakes Period; Winner-list requests must be received no later than August 21, 2026. Residents of Vermont may omit return postage.
19. Social Media Disclaimer The Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Meta Platforms, Inc., TikTok Inc., Snap Inc., X Corp., Google LLC, or any other social media platform. Each Entrant releases each such platform from any and all liability arising out of the Sweepstakes.
20. Severability If any provision of these Official Rules is held to be invalid, illegal, or unenforceable in any respect, that provision will be enforced to the maximum extent permissible, and the invalidity or unenforceability of any provision will not affect the validity or enforceability of any other provision.
21. Entire Agreement These Official Rules, together with the Prize Documents and the Privacy Policy, constitute the entire agreement between Sponsor and each Entrant with respect to the Sweepstakes and supersede all prior or contemporaneous communications, representations, or agreements with respect thereto.
